PUBLIC NOTICE - - - NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Thursday, November 13, 2025 Town of Jackson P O Box 1150 Jackson, LA 70748 225.634.7777 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Town of Jackson. REQUEST FOR RELEASE OF FUNDS On or about December 2, 2025 the Town of Jackson will submit a request to the Louisiana Division of Administration for the release of FY 2025 LCDBG Clearance program funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as FY 2025 Clearance Improvements. The Town of Jackson was awarded a $250,000.00 grant for the removal of slum/blighted properties in the Town. The application identified 29 potential properties to be removed. 14 of those properties were selected to proceed with asbestos testing and demolition to stay within the grant funding allowance. The properties are located throughout the corporate limits of the Town of Jackson. All structures identified are located on private property and found to be detrimental to or endangering public safety, health, or welfare. The Town prepared an Environmental Assessment and determined no other alternatives were available and the project shall proceed with mitigation measures. The properties are dilapidated and uninhabitable. The properties will continue to deteriorate and visually effect the communities in which they are located. The construction shall take place on existing property. The properties were tested for contamination and toxic substances by a qualified Asbestos Inspection company. Six (6) properties were identified to have Asbestos Containing Materials (ACMs and require removal prior to demolition are as follows: - Property #3 – 3017 Market Street - Property #5 – 2744 Market Street - Property #6 – 2728 Market Street - Property #15 – 1151 Walnut Street - Property #18 – 1724 Chestnut Street - Property #22 – 3035 Market Street Properties surveyed and found to have less than 1% Asbestos Containing Materials (ACMs) are as follows: - Property #7 – 3629 Market Street - Property #14 – 1157 Walnut Street Properties were evaluated by the State Historic Preservation Office and Tribes with interest in the area. No known historic properties shall be affected by this project, however an inadvertent discovery clause should be written into the Contract. The project shall proceed with the following Mitigation Measures: Contamination/Toxic Substances - Demolition and Removal of asbestos containing materials shall be conducted by a contractor licensed by the Louisiana Board of Contractors with asbestos specialty. All applicable local, state and federal laws/regulations shall be followed. The Contractor shall comply with strict asbestos abatement for each property that is listed as containing asbestos. Following completion of abatement/demolition a final visual inspection according to LAC Title 33 Part III Chapter 27 §2717 J shall be conducted to complete the abatement activity. If additional suspect ACMs are uncovered which were not accessible during testing, it is recommended that these materials either be assumed to contain asbestos or be sampled before disturbance upon discovery for asbestos content by an asbestos inspector in accordance with 29 CFR 1926.1101. It is recommended that an industrial hygienist monitor the project. Historic Preservation: The Choctaw Nation Tribe of Oklahoma requests that the following inadvertent discovery clause be written into the contract for this project: “In the advent that ground-disturbing work uncovers significant archaeological materials, such as stone arrowheads, ceramics, or early building foundations, or if work uncovers human burials or human remains, ground disturbing activities will immediately be stopped within a 300 foot radius and the materials protected. The State Historic Preservation Officer and the Choctaw Nation of Oklahoma Historic Preservation Department will be contacted as soon as possible, and given an opportunity to provide input before construction resumes. If any archaeological or cultural materials are discovered during the project undertaking, neither the construction team or the applicant will disclose this information to the general public or the media in any manner. Discoveries of archaeological material will be kept private and confidential. ” FINDING OF NO SIGNIFICANT IMPACT The Town of Jackson has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Town Hall, 1610 Charter Street, Jackson, LA 70748 and may be examined or copied weekdays 8:30 A.M. to 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Town of Jackson, P O Box 1150, Jackson, LA 70748-1150. All comments received by Monday, December 1, 2025 will be considered by the Town prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The Town of Jackson certifies to the LA Division of Administration that James McCrory in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Louisiana Division of Administration’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS The Louisiana Division of Administration will accept objections to its release of funds and the Town of Jackson certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Town; (b) the Town has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Louisiana Division of Administration; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Louisiana Division of Administration/Office of Community Development at P.O. Box 94095, Baton Rouge, LA 70804-9095. Potential objectors should contact the Louisiana Division of Administration to verify the actual last day of the objection period.
