PUBLIC NOTICE - - - NOTICE OF APPLICATION FOR AUTHORITY TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE NOTICE IS GIVEN that MARILYN ALBANO COHN, Testamentary Executrix of the SUCCESSION OF HENRY J. COHN, JR., Probate No. 874946 Div. O, 24th Judicial District Court, Jefferson Parish, Louisiana, has, pursuant to the provisions of the Louisiana Code of Civil Procedure, article 3281, petitioned this Honorable Court for authority to sell at private sale, for the price of ONE HUNDRED SIXTY-SIX THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($166,800.00), subject to the terms and conditions of the purchase agreement, including, the payment of $7,000 towards the buyer’s prepaids, discount points and prepaids, and realtor commissions of 5.5% along with the pro-rated taxes and other seller closing costs, the Succession's undivided 5/840 undivided interest in and to the following described property bearing municipal address of 107 Lincoln Road, Monroe, LA 71203: A CERTAIN PIECE OR PORTION OF GROUND, together with all buildings, improvements thereon and all rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the Parish of Ouachita, Louisiana, known as Lot Fifteen (15) Block (1), Unit no. 1 of MAGNOLIA PARK SUBDIVISION, Section Seventy One (71), Township Eighteen (18) North, Range Four (4) East, Ouachita Parish, Louisiana, as shown on the plat thereof made by W.I. Neal, C.E., dated May 7, 1959, recorded in the official records of the Clerk and Recorder for Ouachita Parish, Louisiana in plat book 10 page, page 48 said records, being subject to the act of restrictions dated May 8, 1959 and recorded at COB 669 Page 289 and amended by act dated October 15, 1959 recorded at COB 682 Page 467 of the said official records of the Clerk and Recorder for Ouachita Parish, Louisiana. And A CERTAIN PIECE OR PORTION OF GROUND, together with all buildings, improvements thereon and all rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the Parish of Ouachita, Louisiana, located in Lot Fifteen (16) Block (1), Unit no. 1 of MAGNOLIA PARK SUBDIVISION, Section Seventy One (71), Township Eighteen (18) North, Range Four (4) East, Ouachita Parish, Louisiana, as shown on the plat thereof made by W.I. Neal, C.E., dated May 7, 1959, recorded in the official records of the Clerk and Recorder for Ouachita Parish, Louisiana in plat book 10 page, page 48 said records, being subject to the act of restrictions dated May 8, 1959 and recorded at COB 669 Page 289 and amended by act dated October 15, 1959 recorded at COB 682 Page 467 of the said official records of the Clerk and Recorder for Ouachita Parish, Louisiana and more particularly described as follows: From the southeasterly corner of Lot 16, run northeasterly along the easterly line of Lot 16, also being the westerly line of Lincoln Road (Louisiana State Hwy. 139), a distance of 125 feet for the Point of Beginning; thence continue northeasterly a distance of 10 feet to the northeasterly corner of Lot 16; thence run westerly along the line dividing Lots 16 and 15, a distance of 156.54 feet to the northwesterly corner of Lot 16; thence run southerly along the line dividing Lots 16 and 3 a distance of 5 feet; thence run southeasterly a distance of 155.5 feet, more or less to the Point of Beginning, all as shown in red on the map or plat of V.A. Hubka, attached and made a part of the act recorded at COB 1345 Page 570, Instrument no. 916446 of the official records of the Clerk and Recorder for Ouachita Parish, Louisiana. NOW THEREFORE, in accordance with law, notice is hereby given that MARILYN ALBANO COHN, Testamentary Executrix, proposes to sell the aforesaid immovable property, at private sale, for the price and upon the terms aforesaid, and the heirs, legatees, and creditors are required to make opposition, if any they have or can, to such sale, within seven (7) days, including Sundays and holidays, from date whereon the last publication of this notice appears.
