This motion to table was declared adopted on this 11th day of September, 2025. /s/ Ken Ritter, Mayor /s/ Nicole Guidry, City Clerk ********** The following Ordinance was offered by Matt Romero and seconded by Lindy Bolgiano: ORDINANCE NO. 507-2025 AN ORDINANCE OF THE CITY OF YOUNGSVILLE ESTABLISHING AND RECOGNIZING A FIRE PREVENTION BUREAU WITHIN THE YOUNGSVILLE VOLUNTEER FIRE DEPARTMENT. BE IT ORDAINED by the City Council of the City of Youngsville, Parish of Lafayette, Louisiana that: WHEREAS, La. R.S. 40:1563 provides that a local governing authority may properly establish a fire prevention bureau and a fire prevention bureau thus established may apply for certification by the Fire Marshal to perform inspections on behalf of the Fire Marshal; and WHEREAS, on April 21, 2017 the City of Youngsville and the Youngsville Volunteer Fire Department entered into a Cooperative Endeavor Agreement for firefighting services throughout the City; and WHEREAS, on December 4, 2017 the City of Youngsville and the Youngsville Volunteer Fire Department amended the Cooperative Endeavor Agreement for firefighting services throughout the City; and WHEREAS, the City Council of the City of Youngsville by this ordinance desires to organize the Youngsville Volunteer Fire Department Fire Prevention Bureau (aka the “Youngsville Fire Prevention Bureau”); and WHEREAS, the La. Office of State Fire Marshal requires an updated special ordinance and letter of release from the City of Youngsville in order for the Fire Prevention Bureau to be certified. NOW, THEREFORE, BE IT FURTHER ORDAINED, by the City Council of the City of Youngsville, Parish of Lafayette, Louisiana that: SECTION 1: All of the aforedescribed “WHEREAS” clauses are herein adopted as part of this Ordinance. SECTION 2: The Youngsville Volunteer Fire Department Fire Prevention Bureau be and is hereby organized and created pursuant to and shall operate in a manner consistent with La. R.S. 40:1563. SECTION 3: The Youngsville Fire Prevention Bureau shall operate under the direction of the Youngsville Volunteer Fire Department and shall take all necessary steps to achieve certification by the State Fire Marshal, in accordance with the criteria set forth in La. R.S. 40:1563 (C)(2). SECTION 4: The Youngsville Fire Prevention Bureau, once certified by the State Fire Marshal, shall be authorized to conduct inspections and prescribe regulations consistent with ordinances and regulations adopted by the City of Youngsville, including the provisions of Youngsville City Ordinance No. 287.2-2023, as well as regulations consistent with nationally recognized good practice for the safeguarding to a reasonable degree of life and property from hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials, and devices, and from conditions hazardous to life or property in the use of or occupancy of buildings or premises. The most current adopted version of all codes referenced in Ordinance No. 287.2-2023, will be the minimum code utilized by the Youngsville Fire Prevention Bureau. SECTION 5. The Youngsville Fire Prevention Bureau shall adopt the codes adopted and enforced by the Louisiana Office of State Fire Marshal as described in R.S. 40:1563 and in Title 55: Part V: Chapter 1. The Bureau may also include optional adoption of a maintenance code, State Uniform Fire Prevention Code as described in R.S. 40:1578.7. SECTION 6. The Louisiana Office of the State Fire Marshal has full authority to monitor the Youngsville Fire Prevention Bureau’s performance in those functions which would otherwise be performed by the La. Office of the State Fire Marshal. SECTION 7: The Youngsville Fire Chief is hereby authorized to do the following: 1. Provide a letter to the Louisiana Office of State Fire Marshal releasing the Louisiana Office of State Fire Marshal and any other State entity from responsibility and liability for inspections conducted by the Fire Prevention Bureau. 2. Provide a letter to the Louisiana Office of State Fire Marshal requesting the ability for the Fire Prevention Bureau to conduct fire prevention inspections within the designated service area of the Fire Department. 3. Execute any and all documents and take any and all other actions needed for the Fire Prevention Bureau to be certified as a Fire Prevention Bureau by the Louisiana Office of State Fire Marshal. 4. Oversee or appoint an officer in charge of the Fire Prevention Bureau, to ensure that the bureau is staffed by qualified individuals whose credentials have been reviewed and accepted by the State Fire Marshal. 5. Ensure that all inspectors are qualified individuals whose credentials have been reviewed and accepted by the State Fire Marshal, and who have successfully completed, according to the criteria established by the Fire Marshal, special training in fire inspection and fire codes in a course approved by the Fire Marshal. 6. Provide copies of all inspection reports completed by inspectors of the Fire Prevention Bureau to be filed with the State Fire Marshal’s Office. 7. Ensure that all inspectors complete continuing education courses as necessary to maintain good standing with the Fire Marshal. SECTION 8: All Ordinances, or parts thereof, in conflict herewith are hereby repealed.
