PUBLIC NOTICE - - - IN RE: INTERDICTION OF JAMES HAROLD TOOKE and MARYLANE SHAMBURGER TOOKE CASE NO. 748173P 24TH JUDICIAL DISTRICT COURT PARISH OF JEFFERSON STATE OF LOUISIANA NOTICE OF APPLICATION TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE NOTICE IS GIVEN that Ricky Le Vern Cooper, the duly appointed and qualified Curator of the interdict, Marylane Shamburger Tooke, has petitioned the 24th Judicial District Court for the Parish of Jefferson, State of Louisiana, in the matter entitled "In Re: Interdiction of James Harold Tooke and Marylane Shamburger Tooke," No. 748173P, Division "P," for authority to sell at private sale the interdict's undivided one-half (1/2) interest in the following described immovable property: THAT CERTAIN PIECE OR PORTION OF GROUND, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes, prescriptions, and appurtenances thereunto belonging or in anywise appertaining, situated in the PARISH OF JEFFERSON, STATE OF LOUISIANA, CITY OF KENNER, in that part thereof known as CHATEAU ESTATES LAKEFRONT SUBDIVISION EXTENSION, being a resubdivision of the remaining portion of Chateau Estates Section "A", all in accord with a survey thereof by J.J. Krebs & Sons, Inc., C.E., dated June 27, 1976, approved by Ordinance NO. 1916 of the City of Kenner, registered in C.O.B. 874, folio 958, Jefferson Parish, Louisiana, and according to said survey, the said lot is designated and described as follows: LOT 64 of SQUARE NO. 1, which is bounded by Fleurie Drive, Mercurey Drive, Sylvaneer Drive and the eastern boundary of the subdivision, Petit Berdot Drive and Echezeaux Drive. Said Lot 64 measures 70 feet front on Mercurey Drive, same width in the rear, by a depth of 110 feet between equal and parallel lines. And according to survey by Gilbert, Kelly & Couturié, Inc., Surveying and Engineering, dated September 11, 1979, the property is designated, located and measures as hereinabove set forth. Said Lot No. 64 is shown as commencing 140 feet from the corner of Sylvaneer Drive and Mercurey Drive. All as more fully shown on survey by Richard T. Dading, Land Surveyor, dated November 16, 1987. Also as in accordance with survey by Dading, Marques & Associates, Inc., dated April 25, 1992. Improvements bear the municipal address 6 Mercurey Drive, Kenner, Louisiana 70065. Being the same property acquired by Marylane Shamburger Tooke from Daryl Garrity Himel and Daniel Joseph Himel by Cash Sale of Property dated June 15, 2001, recorded June 20, 2001 at C.O.B. 3054, folio 531, records of Jefferson Parish, Louisiana; further acquired by Glenn Dean Arceneaux Judgment of Possession rendered in the Succession of Deborah Lane Tooke Arceneaux, 24th JDC, No. 867-097, Parish of Jefferson, State of Louisiana, dated August 12, 2025, recorded at C.O.B. 3515, folio 865, records of Jefferson Parish, Louisiana. The property is proposed to be sold to Bonnie Goebel and David Paul Aucoin for the total price of THREE HUNDRED SIXTY THOUSAND AND 00/100 DOLLARS ($360,000.00), all cash (with the interdict's undivided one-half interest being $180,000.00), under the terms and conditions set forth in the Petition for Authority to Sell Interdict's Interest in Immovable Property at Private Sale. The curator represents that the Proposed Sale is sought for the benefit of the Interdict and subject to court approval in these proceedings. Any person desiring to oppose the Proposed Sale or the Curator’s application for authority to sell the property must file a written opposition in these proceedings with the Clerk of Court for the 24th Judicial District Court, Parish of Jefferson, State of Louisiana, within seven (7) days from the date of the last publication of this notice. Oppositions must reference this proceeding caption and docket/case number and must be filed in a manner accepted by the Clerk of Court. Failure to timely file a written opposition within the foregoing delay may result in the Court considering the Curator’s application without further notice to the non-filing party, and the court may authorize the Proposed Sale as requested.
