PUBLIC NOTICE - - - CIVIL DISTRICT COURT FOR THE PARISH OF ORLEANS STATE OF LOUISIANA NO. 2006-05377 DIVISION “E” SECTION NO. 7 c/w 2024-08447 (A) SUCCESSIONS OF ALBERTINE MARRERO FORTUNE A/K/A ALBERTINE JOURDAN FORTUNE A/K/A ALBERTINE FORTUNE, WIFE OF/AND ALBERT FORTUNE FILED: DEPUTY CLERK: NOTICE TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE Whereas, the court approved Co-Dative Testamentary Executors for the Succession of ALBERT FORTUNE, OCTAVIA FORTUNE WOODS, WALLACE FORTUNE AND BRIAN ANTHONY FORTUNE, and the Co-Administrators, OCTAVIA FORTUNE WOODS and WALLACE FORTUNE of the Succession of ALBERTINE MARRERO FORTUNE A/K/A ALBERTINE JOURDAN FORTUNE A/K/A ALBERTINE FORTUNE of the above estates have made an application to the Court for the sale of the immovable property hereinafter described, to-wit: An undivided one hundred (100%) percent interest in and to: A lot of ground improvements thereon, rights, ways, and appertances thereunto belonging, situated in the third District of New Orleans, bounded by D’ABADIE AUBRY, TONTI, and ROCHEBLAVE STREETS and designated by the number 12 of square number 37, on a plan annexed to an act of sale from Charles B. Singleton to Edward Williams executed before Theodore Guyol, late notary on the eighth of April 1871. The set a lot measuring thirty-two feet (32’) five inches (5”) and four lines (4’”) front on Tonti Street by one hundred and forty-eight feet (148’) eleven inches (11”) in depth between equal and parallel lines. The improvements thereon bear Municipal No. 1723 North Tonti Street, New Orleans, Louisiana. UPON THE FOLLOWING TERMS AND CONDITIONS, TO-WIT: (a) The purchase price will be paid One Hundred, Sixty Nine Thousand and 00/100 ($169,000.00) Dollars to these Successions; (b) The successions will pay the pro rata share of taxes for the current year, and the cost of the revenue stamps and of all proper certificates; ( c) The successions will pay the Three Hundred, Twenty Five and 00/100 ($325.00) Dollars City Documentary Transaction Tax; (d) The property is to be sold in an "As Is" condition with the purchasers waiving their Right of Redhibition; (e) The Successions are to pay 2.5 % to seller’s brokerage; (f) The Successions are to pay 2.5% toward buyer’s brokerage fee; and (g) The Successions will pay up to Fourteen Thousand and 00/100 ($14,000.00) Dollars in buyer’s closing fees and prepaid fees. Notice is hereby given to all parties whom it may concern, including the legatees / heirs and creditors of the decedents herein, and of these estates, be ordered to make any opposition which they have for or may have to such application, at any time, prior to the issuance of the order of judgment authorizing, approving and homologating such application and that such order of judgment may be issued after expiration of ten (10) days, from the date whereon the last publication of such notice, all in accordance with law.
