PUBLIC NOTICE - - - CIVIL DISTRICT COURT FOR THE PARISH OF ORLEANS STATE OF LOUISIANA NO. 25-08931 DIVISION " F" IN RE: SUCCESSIONS OF HUBERT J. MORTON JR NOTICE OF APPLICATION FOR PRIVATE SALE Notice is hereby given that the Administrator of the above Estate, has applied to the Court for authority to sell 5414 MacArthur Boulevard, New Orleans, LA 70131 at private sale of the immovable property: THAT CERTAIN PIECE OR PORTION OF GROUND, together with all the buildings and improvements thereon, and all rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the Fifth District, City of New Orleans, Parish of Orleans, State of Louisiana, in that part thereof known as AURORA GARDENS EXTENSION 13-D, all as per plan of subdivision by Adloe Orr, Jr. & Associates, C.E., April 11, 1966, revised June 22, 1966, approved by City Planning Commission, June 27, 1966, registered in COB 670, folio 663, and according to survey of R.L. Schumann & Associates, Land Surveyors, dated February 9, 1973, said property is further designated and described as follows: LOT 46, SQUARE 39, which said Square is bounded by MacArthur Boulevard, Eton Street, Rhodes Avenue (side) and Downey Street (side), and the said lot commences at a distance of 104.83 feet from the corner of Eton Street and MacArthur Boulevard and measures 55 feet front on MacArthur Boulevard, same width in the rear, by a depth of 120 feet between equal and parallel lines, all in accordance with survey of Gilbert, Kelly Couturie, Inc., Surveying and Engineering, dated July 30, 1977. The improvements thereon bear the municipal number 5414 MacArthur Boulevard, New Orleans, LA 70131. Being the same property acquired by Margree Douglas Bailey from Leslie McCutcheon, wife of, and Roderick M. Lincoln by an act passed before Kristina Skold Clark, Notary, dated September 30, 1987, registered in COB 815, folio 225 in the Parish of Orleans, State of Louisiana SUBJECT TO ALL APPLICABLE RESTRICTIONS, RIGHTS OF WAY AND SERVITUDES RELATIVE TO AND EFFECTING THE SUBJECT PROPERTY INCLUDING: 1) the right of way across the rear 5 feet in favor of Louisiana Power and Light Company, registered in COB 673A, folio 240, 2) restrictions dated April 4, 1960 and registered at COB 673C, folio 47. And being the same property acquired by act before Valencia Harrison, Notary, dated May 12, 2004, recorded under NA:2004-26026, CIN: 283590 . To purchaser Eric Carson as is for the sum of $246,000.00 cash. Notice is hereby given to all parties whom it may concern, including the heirs and creditors of decedents.
