PUBLIC NOTICE - - - CIVIL DISTRICT COURT FOR THE PARISH OF ORLEANS STATE OF LOUISIANA NO.: 2022-10948 DIVISION “I” SECTION “5” SUCCESSION OF LYNN BUTLER MAUNEY, WIFE OF THOMAS H. MAUNEY NOTICE OF APPLICATION TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE WHEREAS the Administrator of the above succession has made application to the Civil District Court for the Parish of Orleans, for the sale, at private sale, of the immovable property belonging to the Succession of Lynn Butler Mauney, No. 2022-10948 of the docket of the Civil District Court for the Parish of Orleans, hereinafter described, to-wit: ONE CERTAIN LOT OF GROUND, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the Sixth District of the City of New Orleans, State of Louisiana, in Square No. 351, bounded by Prytania, Leontine, Perrier and Valmont Streets, designated by the letter “H” on a survey made by E. L. Eustis and Sons, C.E., and Surveyors, dated July 13, 1963, and according to which said lot commences at a distance of forty-nine and four one-hundredths feet from the corner of Prytania and Leontine Streets and measures thence forty-five feet front on Prytania Street, by a depth between equal and parallel lines of one hundred and ten feet, and all according to a survey by Gilbert, Kelly & Couturie, Inc., dated May 8, 1974. The improvements thereon bear municipal number 5326 Prytania Street, New Orleans, Louisiana 70115. Being the same property acquired by Thomas H. Mauney by Community Property Settlement by and Between Thomas H. Mauney and Karen Smith, Divorced Wife of Thomas A. Mauney, dated June 11, 1980, registered in Conveyance Office Book 768F, Folio 254-258 of the Parish of Orleans, State of Louisiana, on June 17, 1980. UPON THE FOLLOWING TERMS AND CONDITIONS FOR THE WHOLE OF SAID PROPERTY, TO WIT: (a) The total purchase price shall be $500,000.00 cash. The Purchasers will make an immediate $4,700.00 cash deposit, with the remainder of $495,300.00 to be paid in cash at the Act of Sale, subject to Purchasers’ ability to borrow $376,000.00 with the said immovable property as security. (b) The sale will be “As is”, “Where Is” with Waiver of Redhibition. (c) The sale will be subject to the approval of the Civil District Court for the Parish of Orleans. (d) All encumbrances shall be paid from the sales proceeds. (e) All expenses customarily charged to Sellers shall also be paid from the sales proceeds. (f) The sale shall be subject to such other terms and conditions set forth in that certain Agreement to Buy or Sell Real Estate, Counteroffer, and Waiver of Warranty attached as Exhibits “A”, “B”, and “C” to the Petition for Private Sale of Immovable Property filed by the Administrator on September 19, 2025 in the captioned proceedings. Notice is hereby given to all parties whom it may concern, including the heirs and creditors of the decedent herein, and of this succession, that any opposition which they have or may have to the proposed sale must be filed within seven (7) days from the date on which the last publication of this notice appears, all in accordance with law.
