PUBLIC NOTICE - - - 24TH JUDICIAL DISTRICT COURT FOR THE PARISH OF JEFFERSON STATE OF LOUISIANA NO. 872-481 DIVISION “ N ” SUCCESSION OF ROBERT JOHN SHIRER FILED: DEPUTY CLERK NOTICE OF APPLICATION TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE Notice is hereby given that Patricia C. Shirer and William G. Shirer, the dative testamentary co-executors of the above titled succession, have applied for an order granting them the authority to to sell at private sale, the following described property, to wit: ONE CERTAIN LOT OF GROUND, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the Parish of Jefferson, State of Louisiana, in that part thereof known as EDMO ELMS SUBDIVISION, located in the square bounded by Harang Avenue, north line of the Subdivision, W. Metairie Avenue, King Street and the east line of the Subdivision, and designated as LOT 33, which commences at a distance of 500 feet from the corner of King Street and Harang Avenue, and measures thence 50 feet front on Harang Avenue, same width in the rear, by a depth of 120 feet between equal and parallel lines; all according to a survey by Gilbert, Kelly & Couturie - James H. Couturie, Surveyor, dated February 6, 1984. Improvements thereon bear the Municipal No. 641 Harang Avenue, Metairie, Louisiana 70001. Being the same property acquired by Robert J. Shirer from Kelly Ott, wife of/and Thomas B. Bender, IV, by Act of Sale dated November 4, 2024, passed before Daniel M. Douglass, Notary Public, recorded November 4, 2024 as Inst. No. 12444183 of the records of Jefferson Parish, Louisiana. THIS ACT IS MADE, EXECUTED AND ACCEPTED SUBJECT TO THE FOLLOWING: 1. Any and all restrictions, overlaps, overhangs, servitudes and/or easements, rights of ways and outstanding rights of record which might be shown on a current survey of the property. 2. Restrictive Covenants as recorded at COB 291, folio 292 and COB 46, folio 431. 3. Right of way and/or servitude in favor of Fourth Jefferson Drainage District along the rear five (5') feet of subject lot, as recorded at COB 290, folio 635. 4. Restrictions, servitudes, easements, rights of way, building setback lines and any other matters as shown on the plan of subdivision. 5. Fence encroachments and/or mislocations, five (5') foot servitude across the rear, encroachments and any other matters as shown on the survey by Gilbert, Kelly & Couturie, Inc., dated February 6, 1984, and any matters as may be shown on a current survey of subject lot. Your applicants would be selling the above described property for $165,000 cash payable at a private sale, with the proceeds to be used to pay legitimate debts of the succession and with any remainder being available for distribution to the legatees. Pursuant to the Code of Civil Procedure Articles 3281 and 3282, notice of application of a succession representative to sell succession property needs to be advertised twice in the Parish in which the succession proceeding is pending. Any opposition to the proposed sale must be filed within seven days from the date of the last publication.
