PUBLIC NOTICE - - - ORDINANCE 2026-10 AN ORDINANCE ESTABLISHING A TEMPORARY MORATORIUM ON THE ISSUANCE OF CERTAIN PERMITS, LICENSES, AND APPROVALS FOR USED TIRE SHOPS LOCATED ON MAIN STREET, PLANK ROAD, AND GROOM ROAD WITHIN THE CITY OF BAKER, LOUISIANA BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAKER, LOUISIANA, THAT: SECTION 1. FINDINGS AND PURPOSE. The City Council finds that the City of Baker has a legitimate governmental interest in protecting the health, safety, welfare, and quality of life of its residents and in promoting orderly development within the City. The City Council further finds that it is necessary to temporarily suspend the acceptance and approval of certain applications for used tire shops located on or fronting Main Street, Plank Road, and Groom Road in order to study the impacts of such uses and to consider whether additional zoning, land use, licensing, or regulatory measures are warranted. SECTION 2. DEFINITIONS. For purposes of this Ordinance, the term “used tire shop” shall mean any establishment primarily engaged in the sale, resale, storage, repair, disposal, or other handling of used tires, including any expansion of an existing used tire business that would increase the intensity or scope of such use. SECTION 3. MORATORIUM IMPOSED. A temporary moratorium is hereby imposed on the acceptance, processing, approval, issuance, or granting of any new permit, license, zoning approval, occupancy permit, change of use approval, variance, special exception, or other authorization for a used tire shop located on or fronting Main Street, Plank Road, or Groom Road within the corporate limits of the City of Baker. SECTION 4. DURATION. This moratorium shall remain in full force and effect for a period of [ninety (90)] days from the effective date of this Ordinance, unless extended, modified, or terminated earlier by action of the City Council. SECTION 5. EXCEPTIONS. This Ordinance shall not apply to: 1. Existing lawful uses that do not require a new permit, license, or approval; 2. Routine renewals of existing permits or licenses where no expansion, change of use, or material alteration is proposed; or 3. Emergency actions required by applicable law. SECTION 6. ADMINISTRATION AND ENFORCEMENT. The Mayor, Code Enforcement Officer, Building Official, and all other appropriate officials of the City of Baker are authorized and directed to administer and enforce the provisions of this Ordinance. SECTION 7. SEVERABILITY. If any provision, paragraph, sentence, clause, or part of this Ordinance is held invalid or unconstitutional, such invalidity shall not affect the validity of the remaining provisions, and the remaining provisions shall continue in full force and effect. SECTION 8. EFFECTIVE DATE. This Ordinance shall become effective upon adoption and any publication required by law.
