PUBLIC NOTICE - - - ORDINANCE 2026-08 ORDINANCE AUTHORIZING THE CITY OF ZACHARY TO AMEND CIVIL PENALTY PROVISIONS FOR ADMINISTRATIVE CODE ENFORCEMENT PROCEDURE WHEREAS, the City of Zachary (the “City”) with the adoption of ordinances 2025-21 and 2025-24 established an administrative law code enforcement procedure for the enforcement of select violations of the Code of Ordinances and the Unified Development Code (UDC), WHEREAS, due process requires that the potential penalties for violations need to be clear, specific and authorized by ordinance, WHEREAS, Section 2-70 of the Code of Ordinances for the City of Zachary authorizes the “establishment” of a “schedule of monetary penalties”, WHEREAS, the City now desires to set forth the schedule of monetary penalties, BE IT ORDAINED by the City Council of the City of Zachary that Section 2-70 of the Code of Ordinances for the City of Zachary shall be and is hereby amended in its entirety to read as follows: Sec. 2-70. Penalties. (a) Unless the ordinance at issue contains a specific monetary penalty or fine for violation, whoever violates any ordinance enforced pursuant to this Article shall be assessed a monetary penalty (fine) of not less than fifty dollars ($50.00) and not more than Two hundred fifty dollars ($250.00) per offense. This monetary penalty shall be in addition to all other non-monetary penalties that may be assessed. (b) Each day that a violation(s) continue after the Notice of Violation and Hearing has been served may be deemed a separate offense. (c) Regardless of the number of structures or items in violation on a parcel or lot, each structure or item in violation may be litigated and adjudicated as a separate violation/offense. This Ordinance shall become effective at the expiration of ten (10) calendar days after publication by the City Council for the City of Zachary unless the referenced ordinance shall specify another effective date, all pursuant to § 2-10 (C) of the Home Rule Charter adopted by the electors for the City of Zachary. INTRODUCED FOR ADOPTION by the City Council of the City of Zachary as a regular meeting of the said Council held on the 12th day of May, 2026. SUBMITTED FOR FINAL APPROVAL AND ADOPTED by the City Council of the City of Zachary as a regular meeting of the said Council after being duly noticed and publicized public hearing held on the _____day of _________, 2026 and upon which a public hearing was held, the roll was called on the adoption of the foregoing ordinance, and the Ordinance was adopted.
