ARTS. 354–362 OF MCKINZY ELIZABETH RANDAZZO A Person with a Disability Notice of Application for Continuing Tutorship HATTIE G. GARB will be requesting to be appointed as a Dative or Legal Continuing Tutrix for MCKINZY’S ELIZABETH RANDAZZO who may live with intellectually limiting exceptionalities. Ms. Garb is the minor’s maternal grandmother. If this Court grants Ms. Garb’s request, the court decree will give Ms. Garb the same authority, privileges, and responsibilities as in other tutorships, including authority on the minor’s behalf to give consent for medical treatment, educational planning, to obtain medical, educational, or other records, and other responsibilities until other future court orders. Under C. C. Art. 359, the “legal capacity” of McKinzy would permanently remain that of minor under law until future court orders. Anyone adversely affected by the court’s decree may contest the decree restricting McKinzy’s future legal capacity. An opposition to an application for appointment as legal or dative tutor may be filed prior to the appointment under C. C. P. Art. 4067, must comply with C. C. P. Art. 2972, and must state why Ms. Garb is disqualified or that it would be in the best interest of the minor for the opponent to be appointed tutor instead of Ms. Garb. Any interested person must submit a written objection to Ms. Garb’s request within ten (10) calendar days from the date this notice is published.
