PUBLIC NOTICE - - - CIVIL DISTRICT COURT FOR THE PARISH OF ORLEANS STATE OF LOUISIANA NO. 2025-11170 DIVISION “B” SECTION 11 IN RE: MARIAN HOEY STEM LOAN FUND ENDOWMENT FILED: November 21, 2025 DEPUTY CLERK NOTICE NOTICE IS GIVEN that Hancock Whitney Bank, as Trustee of the Clifford Hoey Stem Trust (“Trust”), has filed a petition to modify the Marian Hoey Stem Loan Fund (“Fund”), an endowment fund that was created from a bequest in the Last Will and Testament of Clifford Hoey Stem dated August 4, 1962 (“Will”), under which the Trust was established. In his Will, Clifford Hoey Stem (“Testator”) bequeathed the residue of his estate unto the Whitney National Bank of New Orleans as Trustee (now “Hancock Whitney” or “Trustee”) of the Trust for the benefit of The Administrators of the Tulane Educational Fund (“Tulane”) as principal beneficiary (specifically to benefit the School of Engineering) subject to the lifetime usufructs of Nellie Williams Stem, Rita Stem Reynick, and Avis Bigelow Reynick Walker. The Testator died on or about December 12, 1963. On March 19, 1964, Tulane passed a Resolution accepting the Testator’s bequest establishing a trust fund for the benefit of the School of Engineering of Tulane University. The bequest was delivered to Hancock Whitney pursuant to an Act of Delivery of Legacy executed on June 7, 1966. On or about January 22, 2023, the last surviving usufructuary passed away, and the usufruct terminated. The Trustee is ready to distribute the trust assets to Tulane to fund the Fund. For several reasons, however, it is impossible for Tulane to administer the Fund as set forth in the Testator’s Will as currently written. First, the Will uses the term “loan,” but Tulane generally administers these types of funds as scholarships. Notably, it appears that the Testator’s intent was to provide students scholarships because there are no terms for repayment set forth in the Trust. Second, the Testator’s criteria for selecting students is based on race, specifically “white Caucasian” and citizenship, specifically “native American,” presumably referencing natural born citizens. Such criteria are not in keeping with Tulane’s institutional policies and could be deemed prohibited under federal law. Accordingly, Hancock Whitney desires that (1) the name of the Fund be changed from the “Marian Hoey Stem Loan Fund” to the “Marion Hoey Stem Scholarship Endowed Fund” to remove the reference to loan and to correct the spelling of the Testator’s mother’s first name from Marian to Marion; (2) the purpose of the Fund be modified to remove race and national origin as awarding criteria; and (3) the Fund language be updated from students who are “average, decent, clean and worthy” to “students with financial need.” Hancock Whitney requests that the name and purpose of the Fund be modified as follows: RESOLVED, that the Marion Hoey Stem Scholarship Endowed Fund be and hereby is established in perpetuity as an endowed fund, the income from which shall be used to provide scholarship support for students in the Tulane University School of Science and Engineering, or its successor. It is the donor’s wish that the scholarship should not necessarily be given to students with the highest scholastic standings but to students with financial need. Pursuant to La. R.S. 9:2332, the Petition can be granted after this notice is published once per week for thirty days in Orleans Parish; any opposition to the petition must be filed prior to the Court granting the requested relief.
